Letter to the Editor – Las Animas property rental business charging illegal late fees

To the Editor:
Netherton Properties in Las Animas is engaging in illegal late fee practices of $10’s a day after the 5th of the month is a direct violation of C.R.S 38-12-105, $50 max or 5% of past due rent which ever is higher. This must be in the lease and cannot be done orally to be enforced.
Furthermore, the property management is in violation of the 2024 Colorado Revised Statutes, specifically Title 38, Article 12, Part 5 (§§ 38-12-501 — 38-12-512) regarding the obligation to maintain residential premises. They are also failing to comply with the requirements set forth in SB 24-094 (Safe Housing for Tenants).
To all their tenants document everything with pictures and always put all health, safety, and habitable issues in writing never tell them verbally, they are only required to take action after a written notice is given. Request a written lease always in writing they are required by law to deliver it to you in 7 days. If their is any mold call PCPHE and report dont bother with the Las Animas health department they contract all issue of such nature out to them. If you are not receiving rent receipts for cash or money order payments then that is another violation of landlord tenant laws. If you have ever been given an eviction notice after you have reported any violations of the habitability warranty laws of Colorado report it to the Attorney General office along with all documentation. The more of you that report Netherton Properties the better.
