NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

This notice shall satisfy procedural requirements for activities to be undertaken by Prowers County.
REQUEST FOR THE RELEASE OF FUNDS

On or after January 18, 2018, Southeast Colorado Enterprise Development, Inc.(Sub-Grantee) will submit a request to the Colorado Department of Local Affairs [DOLA] on behalf of Prowers County for the release of CDBG funds, under Title I of the Housing and Community Development Act of 1974, as amended or Title II of the Cranston-Gonzalez National Affordable Housing Act, to undertake the following project:

Project Title: Prowers County Single Family Owner Occupied Rehabilitation Program.

Purpose: Prowers County SFOO Rehabilitation Program is used for rehabilitation of single family owner occupied homes in Baca, Kiowa and Prowers counties. Low interest loans are made to homeowners to repair health and safety issues in their homes.

Location: Baca, Kiowa and Prowers counties

Estimated Cost: $342,811 (includes HUD funding estimated amount $55,347)

 

An environmental review for the project has been made by Prowers County and is available for public examination and copying at the offices noted below. Based on this review, Prowers County has determined that a request for release of funds will not significantly affect the quality of the human environment and hence, an environmental impact statement will not be undertaken under the National Environmental Policy Act of 1969 (P.L. 91-190).  Additional project information is contained in the Environmental Review Record (ERR) on file at Prowers County Administrative Office at 301 S Main St. Suite 215, Lamar, CO 81052, and at Southeast Colorado Enterprise Development, Inc. at 112 West Elm Street, Lamar, CO 81052 and may be examined or copied weekdays 8:00 A.M. to 5:00 P.M. 

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Prowers County. All comments received by January 17, 2018 will be considered by Prowers County prior to authorizing submission of a request for release of funds.

 

RELEASE OF FUNDS

Prowers County certifies to DOLA that Ron Cook in his capacity as Prowers County Commissioner consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. DOLA’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Prowers County to use HUD program funds.

 

OBJECTIONS TO THE RELEASE OF FUNDS

DOLA will accept objections to its release of funds and the Prowers County certification for a period of 15 days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are made on one of the following bases: (a) the certification was not executed by the Certifying Officer of Prowers County; (b) Prowers County has omitted a step or failed to make a decision or finding required by U.S. Department of Housing and Urban Development regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before the approval of a release of funds by DOLA; or (d) another Federal agency acting pursuant to 40 CFR part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures of 24 CFR Part 58 and shall be addressed to Bret Hillberry, Environmental Compliance Officer, Department of Local Affairs, 1313 Sherman Street, Room 521 Denver, CO 80203.  No objections received after 15 days from the date of request for release of funds will be considered by the state.
